Emeka Eze, who is 35, and Jonathan Akatin, 22, hail from Alheri.

According to the prosecution, the accused committed the offence in the evening of September 7, 2013.

The prosecutor, Gokwat Ibrahim, said that the arrest was made after the neighbours of the pair notified the police of their actions.

Mr. Ibrahim stated that the accused engaged in homosexual act publicly in their compound, and this is “against the order of nature.”

Eze and Akatin violated Section 284 of the Penal Code.

As the accused confessed to the offence, the prosecution insisted on giving them a a summary trial.

“The court should rely on Section 157 (1) of the Criminal Procedure Code (CPC) that stipulates quick judgment for anybody who confesses to his or her crime,” the prosecutor said.

However, according to Mr. Ibrahim, the final verdict depends on the conclusion of police investigation into the matter.

The accused pleaded guilty to the charge, saying they were not aware that homosexual act is an offence.

The Presiding Officer, Mustapha Hassan, ordered that the accused be remanded in prison. The case was adjourned to October 10 for further hearing.
